The crime control model looks to the legislature, as opposed
to the courts, as its "validating authority" " and accepts the extensive
reliance that legislatures place on the criminal sanction. The
criminal sanction is assumed to be "a'positive guarantor of social
freedom" and necessary for the maintenance of "public order."28
