Many thanks for taking my call and please see my e-mail to Paolo Hospital and the attachments regarding Mr AIRDRIE’s son below. From the perspective of the British Embassy, Paolo hospital is denying Mr AIRDRIE his patient rights to have his legal next of kin (his son) to act on behalf of his father. I am extremely concerned that the hospital is obstructing his legal heir to receive any information or take decisions on behalf of their patient. This is a clear breach of article 10 of Thailand’s Declaration of Patients Rights. Even more troubling is that the hospital refuse to share information with the British Embassy, which is also a breach of Articles 5 and 37 (b) of the Vienna Convention of Consular Relations. Currently Mr AIDRIE has no legal guardian.
I fail to understand what legal basis the hospital are relying on to refuse to recognise the son, who wishes to assist his father but the hospital’s non co-operation put Mr AIDRIE at risk of not receiving medical treatment because nobody is able to access his funds legally. I am seriously concerned about the actions of the hospital and would appreciate an explanation. I will soon be obligated to escalate this matter to senior officials at the Embassy and to the Thailand Ministry of Foreign Affairs to intervene.
I would be most grateful for your urgent assistance in resolving this matter. If you are able to register this as a complaint, I would also be grateful for any case reference number.
