ARTICLE 11 INSPECTION OF WORK
11.1 General
11.1.1. CONTRACTOR shall, at its own cost, inspect all materials, supplies and equipment, which are to be incorporated in the WORK in accordance with CONTRACTOR’s established procedures. In addition, CONTRACTOR shall conduct a continuous program of construction quality control for all WORK performed on the SITE and provide OWNER an adequate documentation of CONTRACTOR’s performance of such quality control and inspection. CONTRACTOR’s quality control program and inspection procedures for the foregoing shall be submitted in writing to OWNER, within thirty (30) DAYs from the EFFECTIVE DATE of this CONTRACT, for review and APPROVAL, in sufficient detail to delineate those items to be inspected and the manner in which they are to be inspected, and shall adequately describe all construction quality control activities contemplated.
11.1.2. CONTRACTOR shall maintain a quality assurance system that is in accordance with the requirements of ISO 9001- 2008 for all aspects of the WORK. CONTRACTOR shall employ a full time Quality Assurance Engineer on this CONTRACT through to INITIAL ACCEPTANCE to ensure that all quality assurance aspects of the PROJECT SPECIFICATION and CONTRACTOR’s quality plan are adhered to.
11.2 Access for Inspection
11.2.1. OWNER or others as may be required by applicable laws, ordinances and regulations, shall have the right at all reasonable times to inspect the WORK and all material, supplies and equipment, and all workshops and places where work is being prepared for the WORK at the SITE and at CONTRACTOR’s and its VENDORs’ or SUBCONTRACTORs’ shops for conformance with this CONTRACT, and CONTRACTOR shall provide or caused to be provided sufficient, safe and proper access and facility for inspection.
11.2.2. Except as otherwise expressly provided elsewhere, CONTRACTOR shall during the course of performance of the WORK hereunder, without additional compensation, make or cause to be made all tests required by this CONTRACT. CONTRACTOR agrees that OWNER shall be given not less than twenty (20) DAYs of notice for shop tests and two (2) DAYs notice for field tests to be made by CONTRACTOR or its VENDORs’ or SUBCONTRACTORs’ in order that OWNER may witness any such tests.
OWNER’s failure to inspect materials, equipment or the WORK or to object the defects therein at the time OWNER inspects the same shall not relieve CONTRACTOR of its obligations and responsibilities under this CONTRACT, nor be deemed to be a waiver of OWNER’s rights to subsequently reject defective WORK.
11.2.3. Rejection by OWNER or CONSULTANT of any or all parts of defective WORK for failure to conform with this CONTRACT shall be final and binding.
