The study of the doctors and medical personnel in hospitals under the Ministry of Public Health and the Office of Permannent Secretary for Public Health have been in the prosecution of the medical servicespurposes to study the relationship among the doctors, medical personnel and the patients in public hospitals in the legal and practical problems that cause conflicts in the prosecution, as well as currently available prevention and alleviation measures. This also analyzes the approaches to solve problems and build up the good relationships among the medical personnel, patients and their relatives. Scope of this study is on hospitals under the Ministry of Public Health that were prosecuted during 2007-2012. This study is based from researching and reviewing relevant laws, legal text books, technical reports, minutes of the article on the medical services, report of Tort Liability, investigation, guidelines or manuals on medical practices, court verdicts and cases of negotiation in hospitals and venues of the courts.
The study can be concluded that cases of the most the disputes were from the expectations of the patients or their relatives on treatment provided by the doctors and other medical personnel without knowing about facts and do not understand the treatment process as well as its’ risks and limitations. Medical malpractice is another case of problem that also leads to prosecutions. With better understanding among each other and appropriate remedial help, it’s believed that the conflicts will be preventable or severity of the problems can be reduced. It was also found that a good relationship among all parties on medical services at the beginning of the treatment can reduce chance of conflicts.
Measures to solve the problems on prosecution of medical personnel are proposed in three categories. Firstly, preventing includes: equipping medical personnel with knowledge on relevant laws and regulations; building up good understanding on medical services to all parties; initiating system to promote good relationship among medical personnel, patients, relatives and the community. Second, alleviating includes: setting up a system for negotiating, preparing of the cases; issuing of laws to protect medical personnel and remedy the sufferers. Third, development includes: development of standard medical service system; medical personnel development in both technical and ethical; increase number of medical personnel to meet the demands; development of public communications particularly on medical services.
Therefore, it is recommended that the ministry should formulate its’ clear policy to solve the problems on prosecution of medical personnel covering all measures in three categories mentioned above. The ministry may have to issue relevant laws and regulations in order to set up standard of medical services and ensure that all medical practices in public hospitals are in line with international standards. Public relations and communications on medical services for all stakeholders must be developed as well. In addition, the ministry should issue and amend the laws and regulations to protect medical personnel who are in compliance with professional standards and ethics as well as the laws and regulations to remedy the sufferers fairly.
