In light of the facts that (i) in the Bidding for the Service, the competitors (each of them was
an affiliate of a large-sized business group) were never second to HIT in terms of capital, size,
manpower, and other factors, and they submitted bid prices, which were quite below the
projected price; and (ii) since the Service was not a continuous business but an one-time
business that was to be completed upon submission of a report, HIT’s behavior in the Bidding
did not appear likely to exclude the competitors from the SI market.
