A 14-year-old boy was adjudged to be delinquent by the Juvenile Court of
Fairfield County, Ohio. The boy ap-pealed. The Ohio Court of Appeals for Fairfield County affirmed, 13 Ohio App.
2d 11, 233 N.E.2d 333. The Supreme
Court of Ohio dismissed the boy's further appeal, and the boy filed a petition for certiorari. The Supreme Court vacated judgment of Ohio Court of Appeals that 14-year-old boy was delinquent and re-manded case to give court an opportunity to assess impact of United States Su-preme Court decision that various federal constitutional guarantees accompanying ordinary criminal proceedings are ap-plicable to state juvenile court proceed-ings where possible commitment to state institution is involved, and on such re-mand court could consider impact, if any, on questions raised by boy of intervening order of juvenile court requiring him to face. trial on homicide charge in adult courts.
Judgment vacated and case remanded to Ohio Court of Appeals for Fairfield County.
