10) Termination
10.1 In addition to the rights of the Lessor under this Agreement, if the Lessee breaches any provision of this Agreement and such breach is not remedied by the Lessee within 30 (thirty) days from the date specified in the notice letter sent to the Lessee by the Lessor, the Lessee agrees that the Lessor is entitled to terminate this Agreement immediately and the Lessor is also entitled to claim for damages and any other costs incurred by the Lessor in connection with the breach by the Lessee.
10.2 In the event that this Agreement is terminated due to a breach of this Agreement by the Lessee, the Lessee agrees that the Lessor is entitled to forfeiture of the Security Deposit, Rent and any amount paid by the Lessee to the Lessor prior to the date of termination. In addition, the Lessor is entitled to lease the Leased Premise to other persons immediately without any right of the Lessee to make a claim in respect thereof.
10.3 If this Agreement is terminated without the Lessee breaching this Agreement or if the Lease Term expires, the Lessor agrees to return the Security Deposit to the Lessee without interest within 30 (thirty) days after the belongings and the dependents of the Lessee have been removed from or vacated the Leased Premise and the Lessor has accepted the Leased Premise in good order.
10.4 Unless otherwise specified in Clause 10.5, if the Lessee wishes to terminate this Agreement prior to the expiry date of the Lease Term, it shall be deemed that the Lessee intends to breach this Agreement and the Lessee agrees that the Lessor shall be entitled to forfeiture of the Security Deposit, Rent or any other monies paid to the Lessor in full.
10.5 In the event that the Lessee is transferred from the Kingdom of Thailand due to unforeseen circumstances beyond the Lessee’s control or the decision of the Korean Government, which can be proved to the satisfaction of the Lessor, the Lessee may early terminate this Agreement by notifying in writing of its intention to the Lessor at least 30 (thirty) days in advance. In such a case, the Lessee agrees that the Lessor shall be entitled to forfeiture of the Security Deposit. In addition, as a compensation for the loss of benefits that the Lessor would have received throughout the Lease Term under this Agreement, the Lessee agrees that the Lessor shall be entitled to deduct the loss of benefits suffered by the Lessor from the remaining balance of the prepaid Rent, calculated based on the following rates.

The remaining balance of the prepaid Rent after the deduction hereunder will be refunded to the Lessee after the belongings and the dependents of the Lessee have been removed from or vacated the Leased Premise and the Lessor has accepted the Leased Premise in good order.
The deduction by the Lessor under this clause shall not prejudice the right of the Lessor to claim for any other damages arising therefrom.
10.6 Upon the termination or the expiration of this Agreement, the Lessee shall perform as follows:
10.6.1 The Lessee shall, within 7 (seven) days after the termination or expiration of this Agreement, (i) make all outstanding payments hereunder to the Lessor; (ii) restore the Leased Premise to the original condition as firstly taken from the Lessor, excluding ordinary wear and tear; (iii) vacate from the Leased Premise and (iv) deliver all keys of the Leased Premise to the Lessor.
10.6.2 In case the Lessee is unable to perform the obligations stipulated in the clause 10.6.1 above, the Lessor shall be forthwith entitled to do any of the following actions without protest, obstruction, objection or claim for damages whatsoever from the Lessee:
(a) The Lessor or its representatives shall take possession of the Leased Premise and it shall be deemed that the Lessee is not further entitled to possess the Leased Premise;
(b) The Lessor or its representatives is entitled to break down the door, keys or obstruction and to remove all property out of the Leased Premise;
(c) The Lessor or its representatives is entitled to seize all property left within the Leased Premise as security for damages to be suffered by the Lessor and the Lessee agrees to permit the Lessor to arrange for the sale of the said property;
(d) The Lessor or its representatives is entitled to lock up the Leased Premise and prohibit the Lessee from any access to the Leased Premise;
(e) The Lessor or its representatives is entitled to cut off the electricity power, water supply, disconnect the telephone system and any services served within or for the Leased Premise;
(f) The Lessor is entitled to allow the prospective lessee to enter and utilize the Leased Premise at once; and
(g) The Lessor is entitled to claim by legal action for all outstanding payments together with all costs, losses, damages and expenses incurred due to the failure of the Lessee under this Agreement plus interest at the rate of 15% per year on such amounts from the date of termination until such amounts shall be paid in full by the Lessee.
