If Subcontractor fails to proceed diligently with the re-performance of rejected Services Contractor may, by contract with third parties or otherwise, perform such Services at Subcontractor's expense and/or may terminate this Contract. Contractor may delete from the Work any Services that are not in conformity with this Contract and that Subcontractor has failed to re-perform, repair, replace, and/or correct. Contractor's good faith estimate of the value of such deleted items, together with the reasonable costs incurred by Contractor for experts and consultants to evaluate non-conforming or unperformed items, shall be due and payable by Subcontractor to Contractor, whether or not such deleted items have been or will be supplied or performed by Contractor or third parties.
