Motorcycle case (2003/Thailand)
The dominant company with a market share of almost 75% (AP Honda Co, Ltd) had entered into the following practices: (i) exclusive agreements with its distributors; (ii) removal of competitors’ advertising boarding; (iii) turning dealers away from other manufacturers.
The Trade Competition Commission resolved that the conducts of AP Honda were contrary to Section 29 of the Trade Competition Act and submitted the case to the public prosecutor to take action against AP Honda. The case is presently still under consideration by the public prosecutor though the investigation has taken almost 10 years
