One response to this concern is to hold that legislatures may exercise constituent authority but only after an election in which the possibility of a new constitution is a central issue. We have already seen the example of the Sri Lankan constitution of 1972, adopted after an election in which the prevailing party had pledged to turn the parliament into a constituent assembly.
