Agreement shall be known as The Cafe Shenkin Enterprise Agreement 2015.
2. PARTIES
The parties to this Agreement are:
2.1. Cafe Shenkin Pty Ltd (ABN 63 157 961 469) ("the Employer"); and
2.2. All employees employed by the Employer in the Job Classifications set out in this Agreement ("the Employees").
3. DEFINITIONS
3.1. "Act" means the Fair Work Act 2009 (Cth).
3.2. "Agreement" means The Cafe Shenkin Enterprise Agreement 2015.
3.3. "Allowances" means those allowances set out in clause 29.
3.4. "Capacity" means full time, part time or casual employment.
3.5. "Casual Employee" means an Employee engaged as such.
3.6. "Casual Wage Rate" means the applicable minimum hourly wage rate paid to Casual Employees for all Ordinary Working Hours, including a casual loading. The casual loading is paid instead of entitlements to leave and other matters from which Casual Employees are excluded by the terms of this Agreement and the National Employment Standards.
3.7. "Commencement Date" means the seventh day following the date this Agreement is approved by the Fair Work Commission.
3.8. "Employee Wage Rate" means:
(a) For a Permanent Employee, their actual hourly rate which shall be no less than the
applicable Ordinary Wage Rate; or
(b) For a Casual Employee, their actual hourly rate, inclusive of a casual loading, which shall be no less than the applicable Casual Wage Rate.
3.9. "FWC" means the Fair Work Commission or its successor.
