Please note that the Opponent has filed their Statutory Declaration in Support of their Opposition against registration of your mark, Malaysian Trade Mark Application No. 2013011917 For “Cathy Choo And Device” in Class 3.
Moving forward
The next step in defending against the Opposition would be to file a Statutory Declaration in Reply.
Our professional fees to prepare and file evidence by way of Statutory Declaration in Reply in an opposition proceeding is primarily based on the time spent. Our hourly fees vary depending on the skill and experience of the lawyers (Associate (RM 280 – RM 480); Partner – RM 1,000). As we have received the Statutory Declaration in Reply, we estimate our professional fees on perusing the Statutory Declaration in Support and drafting the Reply to be in the region of RM 3,000 – RM 5,000.
After both parties have filed their evidence, the Registrar shall give the parties a notice to file in written submission to support or oppose the applicant’s trade mark application. Our professional fees in preparing a written submission is also based on the lawyers’ hourly rate but would usually be in the region of RM 2,000 - RM 5,000 in each opposition proceeding.
The deadline to respond is 4 May 2015. In an opposition, the deadlines are extendible for up to 6 months at each stage. The cost of filing an extension of time is RM 100 being our professional fees and RM 80 as the official along with RM 140 for every month applied. Therefore, a 2 month extension will be in the region of RM 460.
Invoice
We further take this opportunity to append herein our re-issued Invoice (previously issued to Tilleke & Gibbins) for services rendered up to 9 February 2015 for your attention and record. We would appreciate the early settlement of our invoice as it has been unsettled for more than 30 days, and the Goods and Services Tax will come into force on 1 April 2015.
