The Contractor also pledges to KHS, subject to the interim arrangement in Section 24 of the Minimum Wage Law, to at least pay its employees the legally required minimum wage based on the Minimum Wage Law as of January 1, 2015, provided a higher remuneration is not owed according to the respectively applicable collective wage agreements or contracts of employment.
The Parties are clear that "minimum wage" is understood to mean the current regular hourly wage - subject to future legal substantiation or divergent case law of the supreme court without the inclusion of special allowances, without piecework rate components, without inclusion of a Christmas bonus, vacation pay, contributions in kind, premiums, special bonuses and reimbursements of expenses.
The Contractor undertakes not to circumvent the statutory minimum wage regulations. The Contractor undertakes to also impose these same obligations on any subcontractors.
