The Supreme Court of Thailand has placed a discipline saying that an employment agreement with a clause of term extension, probation or consecutive agreement is classified as an indefinite term contract, regardless of whether duration of the service period and the term of the agreement will be specified or not. Even though the employment agreement to be made with Mr. Laurent Bastide De Grave will specify the service period, YRT is definitely obliged to serve an advance notice not less than one cycle of wage payment or pay a sum of not less than one month’s wages in lieu of advance notice.
In addition, if the total service period under a single or a consecutive agreement is longer than 119 days, YRT, as the employer, is obliged to pay severance pay under the schedule specified in the Labor Protection Act B.E. 2541. If Mr. Laurent Bastide De Grave is employed by YRT less than one year, YRT is believed to pay up to two months’ wages.
