The parties, in civil law countries, are expected to present evidence that supports their claims and not to supply weapons for their opponent. It is the ultimate importance to clearly define the legal problem so that the judge is able to solve it. Therefore, it is not required that the parties have equal knowledge of all the facts of the case. Consequently, the attorney-client privilege is not necessary used as a tool in the parties’ hands against intrusive disclosure obligations as it is the case in common law countries.
