As you question about the bonus day rate decrease for FSR. I have consulted with Kh. Warawut, legal officer department of the Labour Court of Region 9 and advised us to process as below:-
1. Company process the Memorandum or Inform Letter regarding to the purpose of bonus day rate changing.
2. Announcement Memorandum or Inform Letter to FSR by meeting or face to face (signature of FSR required for meeting acknowledgement)
3. Individual appointment FSR to read and sign NEW bonus day rate agreement contract with including options for an acceptation or rejection on the below of contract (DO NOT force them to sign)
4. If employee might not accept or feels they are not fairly treated by company with regard to such matter, the employee shall directly discuss the grievance with the supervisor within 30 days from the date of which such grievance occurs and upon being notified, the supervisor shall have a discussion with or give suggestions to the employee based on true and correct information within 7 normal working days from the date on which the supervisor is notified of the grievance. If finally employee unacceptable, company has specified several payment to be paid to employees in the case of termination of employment based on "last rate of wage" and “year service” including special severance pay in lieu of advance notice (30 days of the most recent wages) as compliance with the law.
5. If employee might be strike, be absent, abandon duty, abandon work, or avoid work for three (3) consecutive working days whether there is a holiday in between without reasonable cause; company can give him for the Termination of employment without several pay, this is reference to Company Handbook, Chapter 9 : Principles/Policies, section of Discipline, Measures and Disciplinary Action, Part 2 page 57.
