Our aims are constructive in that we identify perilous assumptions and find
a way to define the rule of law without them. Specifically, a clearly defined
concept of the rule of law requires three innovations: (1) it must more
conspicuously incorporate substantive values and theories; (2) it must
incorporate, or at least be plugged into, a coherent theory of law; and (3) it
must make more cogent connections between means and ends. This last
innovation will help guide those engaged in reform to evaluate trade-offs.
