The Casinos offer lines of credit to patrons who gamble at their casinos. (Complaint, ¶¶ 2 and 32.) Patrons seeking credit complete the Casinos' pre-printed credit applications in order to be able to sign “markers” in exchange for chips. (Id.) After a patron establishes a line of credit, the Casino issues the patron a marker, which the patron signs and then uses to obtain chips with which to gamble at the respective Caesars or LVH casinos. (Id.) Each marker resembles a personal check and bears the patron's signature, states the amount of the marker in United States Funds and states “PAY TO THE ORDER OF [THE CASINO]”. The marker also contains blank lines for the name, address and branch of the patron's bank and the patron's bank account number. (Complaint, ¶¶ 4 and 34.) Finally, the marker states that the patron authorizes the Casino to complete the marker by supplying any missing amount, any bank account number, and the name, address, and branch of any bank(s).
