HMV (IP) Limited v Sutton-tech
A fine example would be the dispute between a leading music retailer, HMV, and a Hong Kong company called "Sutton-tech". The latter had registered the domain name"hmv.hk", which HMV saw as an attempt to bank on the popularity of its trademark and business name.
The first cease-and-desist letter sent by HMV was ignored and thus a complaint was filed with the Hong Kong International Arbitration Centre.
The final decision ordered Sutton-tech to transfer the ownership rights of the domain name to HMV as it was confusingly similar to HMV’s trademark rights. Above all, the registrant had not obtained any permission from HMV to use the trademark, and had also attempted to provide false contact information during registration.
