Further to your resignation with our Company effective on ………………… please be advised that despite the resignation of your employment with the Company that you have ongoing obligations to the Company not to disclose the Company secrets and confidential information gained by you during your time with the Company.
You also have an going duty of good faith and trust to the Company not to divulge to any other person confidential information gained from files, records, plans of the Company including but not limited to confidential information in regards to marketing, accounting and financial data, reports plans, policies and practices, overall operations in all respects, contracts, site procedures, production details and schedules, operational plans, or applications for same.
Further, if you have in your possession any documents, files, records or other property of the Company you should ensure that these are returned immediately to the Company. Also you should refrain from contacting staff of the Company in regard to any matter which involves discussion of confidential material.
It is important for you to understand that while you have the right to utilize the skills and experience gained by you in performing your jobs for the Company this must be differentiated from the access you have had to confidential information (and trade secrets) which are peculiar to … …(company name)…….and that a breach of your on-going obligation of confidence would be viewed seriously by the Company.
