I recommend to contact the developer so that they would be aware of the status of the App that they created. Please understand that iTunes is simply a method for content providers to offer their products using our storefront. Apple has no say in how the content providers decided to sell their content, their pricing, and in this case, the App issues. They can start a formal investigation and make the necessary correction to prevent this from happening in the future.
