(i) a description of the proposed design and/or work to be performed and a programme for its execution;
(ii) details of the effect such CHANGE IN THE WORK will have on the PERFORMANCE GUARANTEES;
(iii) the CONTRACTOR's proposal for any necessary modifications to the programme and to the SCHEDULE; and
(iv) the CONTRACTOR's proposal for EXTRA PRICES, determined in accordance with Part 3.3.
3.3 Subject to Article 3.1, CONTRACTOR shall comply with the CHANGE only if CONTRACTOR deems that such CHANGE will not affect the cost or time schedule of the WORK. Any costs incurred by CONTRACTOR to perform such CHANGE shall be for CONTRACTOR’s account, and CONTRACTOR waives any and all rights to claim from OWNER such costs or additional time to perform the WORK as a result of compliance by CONTRACTOR with such CHANGE. If CONTRACTOR believes that any CHANGE may involve a change in the CONTRACT PRICE or time to perform the WORK, CONTRACTOR shall comply with the provisions set forth in Articles 3.2 and 3.4.
3.4 Subject to Article 3.2, CONTRACTOR shall not perform any CHANGE IN THE WORK unless and until OWNER has approved in writing any adjustment to the CONTRACT PRICE for the CHANGE and/or any adjustment in the time for performance of the WORK in accordance with Article 3.2 or until OWNER has expressly authorized CONTRACTOR in writing to perform the CHANGE prior to such APPROVAL by OWNER. Upon receiving such APPROVAL of OWNER or such written authorization to perform from OWNER, CONTRACTOR shall diligently perform the CHANGE strictly in accordance with and subject to all of the terms of this CONTRACT. All sums due to CONTRACTOR shall be paid by OWNER in accordance with Article 13 of this CONTRACT.
3.5 OWNER shall have the right, at any time, to require a CHANGE IN THE WORK and such CHANGE IN THE WORK shall in no way affect the rights or obligations of the Parties except as expressly provided herein.
ARTICLE 4 CONTRACTOR’S PERSONNEL
4.1 CONTRACTOR’s assigned personnel
4.1.1 CONTRACTOR shall provide and employ on the SITE and other locations where fabrication is taking place in connection with the execution and maintenance of the WORK:
(i) an adequate number of well qualified supervisors and skilled-craft personnel; and
(ii) only such technical assistants as are skilled and experienced in their respective callings and such sub-agents, foremen and leading hands as are competent to give proper supervision to the WORK they are required to supervise; and
