Real Estate Lease Agreement
This Lease Agreement is made effective as of the 05th day of May, 2016 by and between Mr. Erno Kiss (“LANDLORD”) Hungarian citizen Passport No.: BH 2472668 and Mrs. Sukontip Pongchananan Birth: 01.04.1973, Mobile :+ 66 89 700 3667 , e-mail: tum_9737@hotmail.com(“TENANT”) Thai citizen ID No.: 3 5701 01370 51 2 The parties agree as follows:
1., PREMISES. LANDLORD, in consideration of the lease payments provided in this Agreement, leases to TENANT for the purpose of RESIDENCE:

Room 408 on 4th floor
Moo 12 , 500/41 Thappraya Road
Nongprue, Banglamung.
Chonburi 20150 Thailand
2., TERM. The room was booked by mobile for private booking.
The lease term shall commence on the 05th day of May 2016, and shall terminate on the 08th day May, 2016.
3., LEASE PAYMENT. TENANT shall pay to LANDLORD lease payments of 4,670 THB.
4., SECURITY DEPOSIT. At the time of the signing of this lease, TENANT shall pay to LANDLORD, in trust, the sum of 5,000 THB ( or similar value currency ) to be held and disbursed for TENANT damages to the premises (if any) as provided by law. This sum is computed as follows:
5., The SECURITY DEPOSIT or the balance thereof not disbursed for damages will be
REFUNDED to the TENANT in check out time.
6., ACCESS BY LANDLORD TO PREMISES. Subject to TENANT’S consent (which shall not be unreasonably withheld), LANDLORD shall have the right to enter the premises to make inspections, provide necessary services, or show the unit to prospective buyers, mortgagees, tenants or workmen. As provided by law, in the case of an emergency, LANDLORD may enter the premises without TENANT’S consent.
7., PROPERTY INSURANCE. LANDLORD and TENANT shall each be responsible to maintain appropriate insurance for their respective interests in the premises and property located on the premises.
8., INDEMNITY REGARDING USE OF PREMISES. TENANT agrees to indemnify, hold harmless, and defend the LANDLORD from and against any and all losses, claims, liabilities, and expenses, including reasonable attorney fees, if any, which the LANDLORD may suffer or incur in connection with the TENANT’S use of the premises.
9., DANGEROUS MATERIALS. TENANT shall not keep or have on the premises any article or thing of a dangerous, inflammable, or explosive character that might substantially increase the danger of fire on the premises, or that might be considered hazardous by a responsible insurance company, unless prior written consent from the LANDLORD is obtained and proof of adequate insurance protection is provided by the TENANT to the LANDLORD.
10., MECHANICS LIENS. Neither the TENANT nor anyone claiming through the TENANT shall have the right to file mechanics liens or any other kind of lien on the premises. Further, the TENANT agrees to give actual advance notice to any contractors, subcontractors or suppliers of goods, labor, or services that such liens will not be valid.
11., ASSIGNABILITY/SUBLETTING. The TENANT may not assign or sublease any interest in the premises without prior written consent of the LANDLORD, which shall not be unreasonably withheld.
12., FURNISHINGS. The LANDLORD, in consideration of the lease payments provided in this agreement, leases to the TENANT for the purpose of RESIDENCE, the Furnishings, listed under Exhibit A, the TENANT shall return all such items at the lease term in a condition as good as the condition at the beginning of the lease term, except for such deterioration that might result from normal use of the furnishings. The said furnishings are to be at the premises located at:

13., INDEMNITY REGARDING USE OF FURNISHINGS. The TENANT agrees to indemnify, hold harmless, and defend the LANDLORD from and against any and all losses, claims, liabilities and expenses, including reasonable attorney fees, if any, which the LANDLORD may suffer or incur in connection with the TENANT’S use of the FURNISHINGS.
14., ENTIRE AGREEMENT/AMENDMENT. This agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written. The agreement may be modified or amended in writing, if the party obligated under the amendment signs the writing.
15., SEVERABILITY. If any other portion of this agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this lease is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed and enforced as so limited.
16., The LANDLORD warrants and guarantees that they have the right, without any restrictions, to lease the premises. It is further specifically understood and agreed that the LANDLORD will inform fully any person or persons to whom they may propose to sell the premises of the existence and terms of this Agreement and that any sale made will be subject to the limitations, conditions and restrictions of this Agreement.
17.,. AMENDMENTS. It is understood by both parties that the following furniture, furnishings and services will be included with and/or on the premises:
A) LANDLORD will pay each and every monthly maintenance fee , maintenance of all common areas, electricity and water bills.
B) LANDORT will pay all utility (water, electric, ) bills .
C) LANDLORD/OWNER will check/service all:
1) Appliances
2) Electrical outlets and switches
3) Plumbing fixtures
4) Air conditioners
D) LANDLORD/OWNER will have all of the above services, repairs and maintenance issues completed prior to move in (05th day of May, 2016).
This Agreement is made in duplicate, the LANDLORD and the TENANT keeping one signed copy each.
IN WITNESS WHEREOF, the parties have hereupon affixed their signatures in the presence of witnesses, thus executing this LEASE AGREEMENT as of the date first shown above and as well, the LANDLORD has received the following amounts:

Security Deposit 5,000 THB
Airport Transfer 0 THB
TOTAL: 9,670 THB
