9.1 The Seller promises the loading rate at loading port shall be 2000MT crane per WWDSSHIC (Saturday, Sunday and Holidays included), even if used.
9.2 Buyer shall provide or cause to be provided at its cost and expense vessels for the transportation of Product from the Port of Loading (the Vessel(s) which shall not be more than ten (10) years of age and suitable in all respects. The vessel mother shall have the facilities loading as per guarantee of loading rate including the loading equipment.
9.3 Demurrage and Despatch shall be USD 4,000/2,000 per day , pro rata
9.4 Notice of readiness to load may be tendered at any time after the Vessel shall have arrived at the pilot boarding area or waiting anchorage at the Port of Loading (the Notice of Readiness or N.O.R.).
9.5 Subject to satisfaction of Seller relating qualification of Vessel and availability of cargo steam according to Clause 8.2, lay time for loading shall begin at 14:00 hours if Notice of Readiness presented before noon (12:00 excluded) and at 08.00 hours of the next working day if N.O.R. presented after noon.
9.6 At Port of Loading, a written N.O.R. to be tendered to agents in ordinary office hours Monday to Friday (08:00-17:00) 17:00 excluded and Saturday (08:00-12:00) 12:00 excluded. Saturday after noon, Sunday and official holidays are excluded.
9.7 Lay time calculation at the Port of Loading to be calculated on gross weight basic per weather working day of fourteen (14) consecutive hours. Sunday and holiday are included. Time not to count from 12.00 hours Saturdays till 08.00 hours Mondays and from 17.00 hours on day preceding Public Holidays till 08.00 hours on day following Public Holidays. Time actually used before commence of lay time not to count. Lay time to be non-reversible.
9.8 Lay time shall cease to be counted after completion of loading the Product according to the Certificates.
9.9 If the Vessel arrives at the Port of Loading prior to the accepted lay can, Seller, at its sole discretion, has the right to load or not to load the Product’s cargo.
