Owner of copyright in dramatic play brought suit against author and producer of allegedly infringing play, and against general manager of infringing production, for their alleged violations of Copyright Act and unfair competition under New York law. The District Court, Haight, J., held that: (1) actual damages claimed by plaintiff under the Copyright Act were too speculative; (2) statutory damages assessed for defendants' willful infringement would be fixed at something less than maximum statutory amount; and (3) defendants were not entitled to punitive damages on state law claim.
