Carrier must notify K-C at least 4 hours of receiving the order via electronic mail if it is unable to meet the order and provide K-C with the reason(s) why it is unable to meet the Order and Carrier must contact or facilitate K-C to contract alternative carriers to provide assistance on meeting the order. K-C shall be responsible only for the rates as set out in this Agreement or as agreed between Carrier and K-C. For the avoidance of doubt, where Carrier is still unable to meet the after contacting alternative carriers to provide assistance, such inability to meet the order shall not be considered meeting the delivery timeline as set out in the Key Performance Indicators in Schedule 4 (even if K-C manages to contract another carrier to provide assistance and the delivery is made on time to K-C’s customers).
