At the 38th Assembly in September 2013, ICAO member state finally agreed to develop a global MBM scheme for international aviation, but couched this in terms which offer loopholes, and with continuing fundamental differences on both the CNG2020 goal and CBDR&RC reflected in the text and also subject to numerous ‘reservations’ ( a provision whereby individual states indicate that they do not commit to a clause or clauses concerned). Report back ‘for decision’ will be made to the Assembly in 2016 with earliest implementation date being 2020. The Assembly thereby essentially kicked agreement on MBMs into touch for at least a further three years. This means that an agreement on international aviation will not be available in time to align with the aligh with the planned adoption by the UNFCCC by 2015 of a global legally binding agreement on climate change, although the proposed implementation date from 2020 could be consistent. If ICAO fails to reach a substantive agreement in 2016, there is a prospect of a complex, overlapping and possibly duplicative patchwork of emissions regimes emerging towards 2020, which could harm aviation and tourism alike.
