Dear Sirs,
My client Yves Bardon purchased unit 1906 at H Sukhumvit 43 condo with the promise of a luxurious condominium that would be delivered within December 2014. After a long wait, my client recently inspected his condo and I was there to assist him. Here is his feedback.
Mr. Bardon was extremely disappointed when he discovered the unit he had purchased, the materials are extremely cheap and the condo is miles away from what the developer sold him. Not only that, the works have been poorly executed and we counted an endless list of defects in this 2 bedroom unit. I verified the technical description attached to the sale and purchase agreement and found out that the wall finish had been changed! While it was supposed to be painted with a light beige color, it is now covered with a horrible light pink wallpaper. This is only an example that reflects the type of construction errors we noticed. How could your construction teams, your technicians and your supervisors miss on so much?
Amongst other things:
- Wallpaper on the walls whereas they were supposed to be painted.
- Overlapping painting everywhere. (On the furniture, on the wall paper, on the door frames, on the ceilings...)
- Non straight walls that lead to huge gaps with the fitted furniture and obvious defects under the wallpaper.
- Door frames are badly adjusted and some do not fit the space. Some are not even straight.
- Bottom of door frames doesn't fit with the rest of the wood.
- Counter top in the kitchen is not only poor quality but also completely scratched.
- Water tap in the kitchen is not fixed.
- Electricity plugging is unsafe under the kitchen counter.
- Kitchen island is poorly built.
- Electricity plugging behind the built-in furniture is unsafe.
- Almost all electric plugs are not straight.
- Ceiling painting is badly executed.
- Ceiling is not straight.
- Joints on the balcony are absent.
- Ceiling ventilation in the bathrooms is not fixed properly.
- Joints around the bathtub are missing.
- Fitted furniture is not fixed properly. It's so cheap it's even better to remove it.
- In the bathrooms, the water tubes attached to the walls are not even fixed with silicon.
- Air conditioning units are not straight.
- Bathroom window in the master bedroom is not fixed properly, adjacent wall is not straight at all.
- The choice of water proof plugs in the bathroom may fit a psychiatric hospital but not a luxury condo. Not only they look horrible but they are also badly placed.
The list goes on and this is just intolerable for my client.
My client was so disappointed by his experience with this condominium that I am putting my own reputation at stake here. Your transfer team offered to us to completely refinish the unit but my client refused. The defects come in such large quantity and to such extent that he doesn't want to step foot in there again.
In your sale and purchase agreement, clause 7.3 states that the purchaser has the right to cancel the purchase of the unit if the developer fails to deliver within December 2014. Not only we are in June 2015 but also the unit is well below the standard my client expected and filled with incomprehensible defects.
Please let me know:
(1) if you agree to let my client activate this clause and reimburse all monies paid to date + interest.
(2) Amounts payable in the case of a refund.
(3) Any questions or comments you may have.
I must tell you right now that my client will not hesitate to consult his lawyer if an agreement cannot be found amicably and rapidly. Since we already addressed each and every of the above mentioned issues about 2 weeks ago and no one replied till now, I certainly expect a prompt reply from your company.
