6. Confidential Information will not include information which:
a) was or becomes generally available to the public other than as a result of disclosure by Recipient to the public or any third party in violation of this Agreement;
b) becomes available to Recipient from a source other than the performance of his/her duties, provided that the Recipient has no reason to believe that such source is itself bound by a confidentiality or non-disclosure agreement with Company otherwise prohibited from disclosing such Confidential Information by a legal, contractual or fiduciary obligation,
c) was rightfully in Recipient 's possession prior to receipt from performing his/her duties, or
d) is independently developed by Recipient without the use of the Confidential Information. If Confidential Information is required to be disclosed by Recipient by a governmental agency or law, such Confidential Information may be disclosed pursuant to such requirement so long as Recipient provides Company with written notice of the required disclosure upon receipt of notice of the required disclosure, to the extent permitted by law, and coordinates with Company in an effort to limit the nature and scope of such required disclosure.
