Refer to your question below concerning the effect to the Representative office establishment, we would like to clarify as follows.
The application for the Representative office establishment shall be filed to the Department of Business Development (DBD) and at the time of the filing, all supporting documents including Annexure 1 – 5 are required to be completely filled. However, the DBD office will not be the organization that check whether the foreign – Thai staff filled in the annexure 5 is fully complied with the quota regulatory. The Ministry of Labor will be the organization that check whether DSOSL actually has Thai staff in compliance with the quota regulatory at the time DSOSL file for the work permit of its staff after the Representative office has already been established.
Accordingly, we would like to inform you that DSOSL is able to file the application for the Representative establishment once the information in annexure 3&5 is completely filled in paper regardless whether DSOSL actually has Thai staff in compliance with the quota regulatory at the time of the filing to DBD. However in this case, we urge that DSOSL must be able to actually find Thai staff to comply with the regulatory before the time DSOSL files for work permit at the Ministry of Labor. The process for the DBD to review the application before granting permission to set up Representative office usually takes about 60 days . Therefore, we believe that DSOSL would be able to find Thai staff to comply with such quota within that time. In addition, please note that the estimated expenses in annexure 3 shall be consistent with the hiring cost of all DSOSL staff in annexure 5.
