About us
The jurisdiction is part of the First-tier-Tribunal Health, Education and Social Care Chamber. The Chamber President is His Honour Judge Phillip Sycamore. The Deputy Chamber President with responsibility for the Primary Health Lists jurisdiction is Judge John Aitken. All panel members have been appointed by the Lord Chancellor. The jurisdiction covers England and Wales.
The jurisdiction is administered by Her Majesty’s Courts and Tribunals Service and the jurisdiction’s administration is undertaken by the Secretariat offices based in Mowden Hall, Darlington.
The Chamber President and his senior judicial management team work closely with the Secretariat to manage the jurisdiction.
The Primary Health Lists jurisdiction is completely independent of the Department of Health and is not accountable to the Secretary of State for Health. Appeals and applications are made to it directly.
Cases we handle
Currently General Practitioners (GPs), Dentists, Optometrists and some Pharmacists need to be on a locally managed performers list before being able to provide NHS services within the NHS. The Primary Health Lists jurisdiction hears appeals/applications resulting from decisions made by NHS as part of the NHS management of such performers' lists.
We deal with applications to remove national disqualification.
The Tribunal also deals with appeals regarding Local Pharmaceutical Services.
The appeal will normally be dealt with on evidence, with the parties attending. Some hearings may be dealt with on the papers if the Tribunal agrees. Panels do not give their decision at the end of the hearing. All decisions are given in writing and are placed on the website.
Onward appeals are heard by the Upper tribunal Administrative Appeals Chamber on a point of law f permission is granted.
