China based company A imports goods from company B located in another country. The shipment are to be made in two lots. The payment is by two separated irrevocable letters of credit at sight for each shipment. After the first shipment is effected, company B presents document within validity of the first L/C to negotiating bank for availability of payment by negotiation and the negotiating bank pays the proceeds to company B after examination of the documents without discrepancy. Then the issuing bank reimburses the negotiating bank. After receiving the goods of the first shipment, company A finds the quality of the goods is not in accordance with the stipulation of the contract, so company A requests the issuing bank to dishonor the documents presented for availability of payment under the second L/C. This request is rejected by the issuing bank.
