“This is very common in HK and use myself as an example. When I (HK GM) worked for my previous company, a HK registered company, I need to be stationed in Shanghai. My employment contract is still with the HK company under HK law but I worked outside HK. Even we have registered companies in China but I did not sign any employment contract with them. We even have staffs from other countries signing the employment contract with the HK registered company but working in other Asia Pacific regions. My previous company is a US Fortune 500 company with a HK registered company and I believe they checked also the local labor law too.
Besides, our current Macau CDE comes from Fuji Xerox and he also signed the EA with their HK company but working in Macau.
HK is quite flexible in this aspect as, I believe, this is one of the factor for HK need to be competitive to be an AP hub.”
