Without prejudice
Dear Ricardo,
As mentioned at the outset, we consider and have treated the ImaginMe work as a single project. We have, out of consideration for ImaginMe’s constraints, divided the project in to phases. The phases are not separable or exclusive of one another. ImaginMe committed to a payment schedule as well as to the delivery of assets in a timely fashion. Neither of these requirements has been met.
Despite the fact that you are in breach we are, perhaps mistakenly, attempting to leave the door open for you to address these challenges. If we are in breach in your opinion then you may pursue your rights under Singapore law and discharge the contract if I am not mistaken. We have chosen not to do so as we would like to finish what we started. The prerequisite for this is that you to follow through on your commitments.
If you want to get the lawyers involved then so be it.
I await the detailed list of issues you have with our “work” which was also requested on Friday the 28th of October.
