Notwithstanding anything in this Agreement to the contrary, the Seller shall only be obliged to purchase the Asset from the Owner in accordance with Clause 2.3, if the Owner takes all necessary and timely actions in accordance with the agreed schedule (“Schedule”) to re-possess the Asset once the Customer fails to make payments in accordance with the original loan amortization schedule. If the Owner permits the Customer to deviate from the original loan amortization schedule, or if the Owner fails to re-possess the Asset and notify the Seller with the Detailed Breakdown in accordance with Clause 2.3 within four (4) months of the failure of the Customer to make payments in accordance with the original loan amortization schedule, the Seller may purchase the Asset at 80 percent of the outstanding balance of the principal in accordance with the original loan amortization schedule, instead of the actual principal balance outstanding
