We write on behalf of the Kamala Falls Condominium Juristic Person, a condominium registered under the Condominium Act of Thailand (Registration No. 5/2554).
Various co-owners of Kamala Falls Condominium have requested we enquire with you in relation to the feasibility of developing and constructing buildings on a plot of land next to the Kamala Falls Condominium, as shown on the attached map at Annex A. We understand your office is authorized to issue construction and building permits in relation to such land as the land falls within the Kamala Sub-district.
Accordingly, we hope that you are able to clarify the following:
1. Do the environmental regulations of Phuket permit construction of residential or commercial buildings on said plot of land?
2. If the regulations do permit buildings to be constructed on the land, could you please confirm the Kamala Tambon Administration Office the office which would issue the building permit?
3. We understand a portion of the land is above the ‘80 meter’ threshold and that buildings on the land in relation to the Ministry of Natural Resources and Environment Notifications: Territory and Environment Protections Measure for Phuket Province B.E. 2553 are restricted. Can you confirm this is the case and that the land is subject to the aforementioned rule?
