LEASE AGREEMENT
THIS LEASE AGREEMENT is made on20 July, 2015 between: Miss.Saowalak Chaiyo hereinafter called the“LESSOR”residing at Aguston Sukhumvit Condominium Unit No. 140/68, Soi Sukhumvit 22, Sukhumvit Rd, Klongtoey, Bangkok 10110 Age 34 years , holds ID/Passport no. 3 8099 00407 05 6 Nationality Thai Citizen
And Mr. Shotaro Yamauchi Age 47 years, holds passport no. MZ0717918 Nationality Japanese,hereinafter called the“LESSEE”residingat 124 Soi Sukhumvit 53 , Klongton-nue,Wattana, Bangkok 10110
Staying Mr. Hiroyuki Iida Age 54 years, holds passport no. TH4158439 Nationality Japanese, hereinafter called the “LESSEE” residingat NISSANTRADING (THAILAND) CO.,LTD. 14thFL,Siam Motors Bldg.,891/1Rama1Road,Pathumwan,Bangkok, 10330 Thailand
The Lessor is the owner of an apartment worth 151.23sq.m (including balcony), Aguston Sukhumvit Condominium Unit No. 140/256 Floor 31, Soi Sukhumvit 22, Sukhumvit Rd, Klongtoey, Bangkok 10110 hereinafter called the “PREMISE” . The premise is furnished with attached fixtures and furniture.
The Lessor agrees to let and the Lessee agrees to rent the premise under the following terms and conditions:
A. The Lessor and the Lessee hereby agree as follows:
(1) The term of this agreement is 1 months and 20days commencing from 20 July, 2015 and terminating on 31 August, 2015.
(2) The rent shall be 80,000 Baht (Eighty Thousand Baht Only) per month, payable no later than the 5 of each month.
Every payment to be made by the Lessee to the Lessor hereunder shall be deposited to the Lessor’s saving account at:
(3) Upon the execution of this agreement, the Lessee shall deposit with the Lessor 160,000 Baht (One Hundred and Sixty Thousand Baht Only) hereinafter referred to as “THE SECURITY DEPOSIT” The Security Deposit shall be returned to the Lessee after all payments, bills and any deduction of damage have been settled and shall not be applied for the rent of the last month. (The Security Deposit shall be returned to the Lessee within 30 days after all payments, bills and any deductions of damage have been settled)
B. The Lessee agrees as follows:
(1) To keep all floor, floor covering, walls, ceilings, windows, doors, furniture, domestic appliances, and all fixtures and fittings in or on the premise in the same condition but allowing for normal wear and tear caused by use during the term of this agreement.
(2) To use the premise for dwelling purposes only and shall pay the following bills by himself / herself on time
- Electricity Supply = as billed by actual billing ,Paid by Lessee
- Water Supply = as billed by actual billing ,Paid by Lessee
-Telephone = as billed by actual billing ,Paid by Lessee
- Hi Speed Internet = as billed by actual billing ,Paid by Lessee
(3) To Permit the Lessor or his agent to enter upon the premise for the purpose of inspection at all reasonable times during daylight hours subject to reasonable notice and to permit during the thirty days before the expiration of this agreement, the Lessor or his agent to show the premise to prospective tenants at reasonable times, provided that prior arrangements are made with the Lessee.
(4) Not to make any alterations or additions or install any fixtures to the premise without prior consent in writing of the Lessor. Any and all major alteration or additions made or fixtures installed by the Lessee to the premise without consent of the Lessor shall become the property of the Lessor.
And if the Lessee does so without such consent, he/she must, if the Lessor so desires, on the request of the Lessor, restore the premise to the former condition at his/her own expense,
and is liable to the Lessor, for any loss or damage that may result from such alteration or addition.
All other properties brought into the premise by the Lessee and / or his/her family shall at all times be the property of the Lessee.
(5) Not to keep with the Premise any contraband goods, explosives, inflammable goods, acid or alkali chemical products or any stuff or materials, which may be detrimental to the leased premise.
(6) Neither assign nor sublet the premise or any part thereof without prior written consent of the Lessor.
(7) Not to do nor permit to be done on the premise anything which may cause nuisance or interference with the quiet enjoyment of the neighboring premise or their occupants.
(8) If the Lessee desires to raise the pet in the Premises, the Lessee shall strictly comply with the rule and regulation prescribed by Aguston Sukhumvit 22 Condominium Juristic Person. The Lessee shall keep his pet not to louden, or not to make harm to the Premises or not to make harm to the Lessor's furniture in the Premises which to taken possession by the Lessee, or not leave the pet in the Common Area, or keep his pet not to make nuisance, or keep his pet no to make harm to other co-owners. If the Lessee neglects or negligently cause pet to make loud or make harm to other persons, the Lessor has the right to restrain to raise the per including the Lessee shall solely pay the damages caused by his pet
(9) To notify the Lessor or his representatives of any damages or defects at the premise within seven days of the occurrence of such damage or defect.
(10) The Lessee is bound to take as much care of the premise leased, as a person of ordinary prudence would act within his own property and to do ordinary maintenance and pay for minor repair.
(11) The Lessee shall follow the regulations and rules prescribed by Aguston Sukhumvit 22 Condominium Juristic Person.
(12) That at the end or sooner termination of the tenancy, the lessee will remove his/her belongings and return all the keys of the premise to the Lessor. Should the Lessee delay in return the Premise to the Lessor, the Lessor may decide to charge the Lessee the rent on delay basis or remove the Lessee’s belongings at the Lessee’s expense
(13) In case the Lessee terminates this agreement prior to the expiration date as stated in subsection A (1) the Lessee agrees to give the Lessor all deposit that is exclude all bills of electricity and water, repairmen fee for any damage and cleaning fee.
(14) Prior to expiration of this Agreement, If the Lessee shall be desirous of renewing the Agreement, the Lessee must notify to the Lessor with minimum of 30 (Thirty) days prior to the expiration date in writing. If the Lessor agrees to renew the Agreement. The rental payment and service fees shall be subject to new Agreement.
