There is also one observation which one should not fail to take into account. That is, one cannot not legislate human behaviors. Despite the existence of legal provisions which should guide behaviors, there would be deviants and violators. This is because of the undeniable fact that the political culture element can weigh heavily in determining one?s action. Small wonder that abuse of power, violation of the legal principles by policies or actions which contravene the charter abound in countries with fledgling democracies. This is related to the third element which is equally if not more important than the other two, the existence of democratic political culture on the part of the elite and the masses.
