At present, conducting illegal abortion is the major health problem in Thailand that should be solved urgently. This is because it has been controversy widely for many years and has affected to health and life of people throughout the country. In addition, causing damage to both society and economy. Although abortion is an offense under the Penal Code and there is periodical suppression, it also provides constantly news about conducting illegal abortion in various media on a regular basis such as newspapers, radios, televisions, etc. The Majority of the parties involved in illegal abortion such as social workers, criminologists, physicians, academicians, lawyers, organizations, and general public have tried to find the solutions towards illegal abortion but it cannot be solved. The main constrains to this problem from the opinions of society link abortion are various; interestingly, on morality and personal emotion. The abortion remains a criminal offense; therefore, the abortion rate is declined. In fact, abortion statistics in Thailand is increasing continuously. It means that the abortion law enforcement is ineffective because the crime is still remaining. On the contrary, although the criminal law states an abortion is a crime, there is no any other social measures to help the unwanted pregnant women to take care their babies and themselves. This leads them to conduct unsafe and harmful abortion. Thus, this article aims to study the legal measures, which are consistent and appropriate to the circumstances of the unwanted pregnancy and abortion. The result of this study is benefit to serve them the alternative ways properly in order to decrease the problems of conducting illegal abortion, and its loss physically and mentally complications. Additionally, it reduces other crimes arising from conducting illegal abortion; for example, discarding or killing newborns, unwanted enfant, homeless children, drug or fraudulent sale of the abortion pill.
