Refer to this case.
Upon followed up and discussed with surveyor, we noted by them that no accident during transit and no securing such as lasing for the cartons on top in container. In this regard, may we quote their comments for your information as below:-
“We informed you that the freight container no. SIPU2201590 (20’) of cargo of assorted liquor was known to be in sound condition. During unloading of cargo, the Insured found that some cartons had damaged packaging. The cartons appeared to be bulged. The capsule foil covering the cork had been detached and loose with the corks moved and pushed out from inside the bottles. (As revealed, this problem had occurred in the past but there were minor affected cargo).
Based on information obtained, we noted no accident or irregularity during transit which is related with the cause of the loose capsule foil and corks. As there was no other object mingling or hit with the cargo / bottles / cartons inside the container, we are of the opinion that any problem with the cargo itself for this kind of cargo is likely to be attributable to inherent vice.
There were also broken bottles from the top loaded cartons. From the photographs of Insured, we are of the opinion that the top loaded cartons were loosely stowed (no securing) and could move/hit each other, likely causing the breakage. We are of the view that breakage was a result of the non-securing or manner of stowage.”
At this stage, we would recommend you to inform this case to Shipper and carrier, and let us know the standard container stowage, and/or any documentary evidence from carrier to show that there was some accident during transit caused the cargo attacked each other.
