Let me run you through what has happened here because I think you are representing yourself and Patara Elephant Farm poorly.
In January, 2012 I visited Patara Elephant Farm where I paid a great deal of money to tour the facility. You were paid by Patara to follow my group around with a camera and take pictures of us enjoying the elephants and surrounding area. After the tour, we were given the pictures and video on a disk so that we could take it home and share it with whomever we liked. None of the pictures on the disk were watermarked or copyrighted or claimed by any photographer like yours is above, which led me to believe, I was the sole owner of these pictures, along with the others in my group at the time.
Now 3 years later you are attacking me by telling me I stole your photographs. I am sorry that it may look like this, but given my explanation of what really happened, I don't believe I have done wrong. If I had visited your website and downloaded the photo, removed your watermark and put my own on it, then yes that would be stealing. But I DID NOT do such a thing. What about the videos on that disk? Are you going to sue me for putting them on YouTube?
I do feel terrible now that I know this photo is not mine to use and was not given to me to use without permission. The last thing I want is to look like I stoke anybody's work, so please forgive me for that. However, I don't see how you could give away your photos to paying customers and then make such allegations that they have been stolen and then on top of that threaten to SUE them. What is the point of offering this service to your customers if this is the result?
I hope you think about what I have said because I did not have any ill intentions towards you or your work. Now that I see that, yes that photo in particular is being used by you in your portfolio, I feel bad that it is being represented on this website as my own. I wish they would take it off and we could end this here.
