Makishima is meant as the hero of this story. The one that tries to free society from it's state.
I noticed this around episode 5 or so.
Makishima didn't just escape because the show needed a bad guy or because he was the mastermind. Not at all. As you can see in the anime the are several other people with that characteristic of not being judgeable.
Kougami is his counterpart, but he only serves the role of better explaining Makishima.
Anyways the way i see it, it's as if he tries to convey a message, about a future where society is fully controlled and he'd like that to be prevented.
