- Khun Buppha performed well in answering the Plaintiff lawyer's questions and explaining her views.
- As anticipated, the Plaintiff lawyer, through the questions asked, attempted to distort/interpret the evidence to make the Plaintiff appear as the Defendant's employee. For example, the Plaintiff's lawyer pointed to documents where: (i) the Plaintiff had signed on behalf of the Defendant and (ii) the Defendant had included the Plaintiff in marketing materials for the Australian Chamber of Commerce, Thailand.
- However, Khun Buppha responded well, generally saying that documentation was key and there was no employment contract between the Plaintiff and the Defendant.
During the course of proceedings, The Judge indicated that it would be useful to have evidence from a Thai Leighton accountant to talk through the documents showing payments to Siam Alba. Given this, we think that it would be useful to call another witness to talk through these documents. Khun Buppha has suggested a senior accountant (whose name she will send through to us later, probably today). We will be able to call this witness at the hearing on 7 December 2016 and simply need to submit a statement from them on that day. The statement will, like Khun Buppha's be very much a walkthrough of the documents.
We anticipate that we will incur approximately THB 150,000 in further fees preparing the witness statement and the witness. However, given that it was the Judge's wish to have more of this evidence, we think that it would unwise to not call another witness. Therefore, we will begin work on preparing the new statement. Please let me know if you are happy with this approach.
