There is no separate provision relating to harassment at work in either the SDA 1975 or the RRA 1976. However, it is specifically covered by the Race Directive. Any complaint must be made under the heading of direct discrimination. The recognition of this as a serious head of claim is fairly recent. The definition of sexual harassment is wide and encompasses any conduct meted out in a particular way because of the complainant’s gender or race; that is, it is not confined to conduct of a purely physical nature, even though many of the cases involve this type of conduct.
