Please see attached. Based on all the correspondences on this subject, I have made the highlighted changes to make Invoice good for all parties. I will describe below:
1. This Invoice should be called a “PRO FORMA” Invoice. This means “in the form of” an invoice. It is used as a substitute for a formal invoice where there is no actual sale. So, the PRO FORMA INVOICE will have all of the commercial terms needed for customs purposes, but clearly states that there is no commercial sale.
2. HMMT has requested that the “FOB” amount for the returnable packaging be listed on the invoice. HMM understands that HMMT is referring to “FOB” as the “value” in Thai Bahts of the returnable packing HMM is returning to Thailand. However, HMM would like to avoid writing words “FOB” on the invoice because this has meaning in US that racks have been sold to HMMT, which is not the case. Therefore, HMM has removed the words FOB from invoice.
3. I have added the words “INCOTERM for Freight and Insurance: CIF.” This reflects agreement between HMM and HMMT. HMM is responsible for paying cost of ocean freight and marine insurance to Thailand. This is the appropriate INCOTERM to reflect this transaction.
4. I have added additional words to “*”. It should be included that the racks have no commercial value and that the racks are not for re-sale in Thailand.
