in the even that the purchase does not exercise the right to serve notice to terminate the agreement as per item 10.3.1
the seller agrees to the purchaser's right to impose a penalty fine at a daily rate of 0.01
not less than 0.01 of the selling price of the condominium unit entered into the agreement but in aggregate not to exceed 10
but if the purchaser does exercise the right to the full ten percent of the condominium unit cost
and the purchaser it of the opinion that the seller will not be able to comply with the agreement any further
then in such circumstances the purchaser shall have the right to serve notice to terminate the contract
