(c) as to my household contents for Matthew provided that if he fails to survive me but leaves issue who survive me then those issue shall take by
representation (and if more than one in equal shares as tenants in common) The benefit of my estate which their parent would otherwise have
taken under this my will.
Establishment of testamentary trust
6. I give the residue of my estate (" the trust fund") to be help by Matthew as trustee ("the trustee") upon the terms set out in Claud 7, with the
'principal beneficiary' referred to in that clause being Matthew - to be known collectively as "Matthew Ian price's I estamentary I rust (out if his
appointment fails as trustee then such person (s) as may be appointed by Matthew in writing whether by his will or otherwise shall be the
trustee(s) and in default of his making an appointment or if this or any subsequent appointment fails then:
(a) where the appointment fails because of the death of the last surviving trustee, his or her legal personal representative shall be the trustee;
(b) where the appointment fails otherwise than because of the death of the last surviving trustee, the trustee shall be the person who would be
entitled to be appointed as the legal personal representative of the last surviving trustee if he or she had died at the date the appointment
failed).
7. In respect of the trust set up under Clause 6 the following provisions shall apply:
Terms used in testamentary trust
(a) Unless the context otherwise require, in this trust:
(i) "beneficiaries" means:
(A) the principal beneficiary;
(B) any natural and/or lawfully adopted child, grandchild or other issue of the principal beneficiary;
