We understand that the construction of the building was completed around 4 years ago. In respect of incidents 1, 3 and 4, the damage observed is consistent in nature, comprising the swelling and dampness of bathroom walls and flooring. During our site inspection, we noted that other parts of the common areas of the building had similar damage and we conclude that the deterioration of the waterproofing of the exterior wall was the likely cause.
The policy covers sudden and unforeseen damage and specially excludes "...Corrosion rust extremes or changes in temperature dampness dryness wet or dry rot fungus shrinkage evaporation loss of weight pollution contamination change in color flavor texture or finish action of light vermin insects marring or scratching...".
In respect of incidents 1, 3 and 4, the damage has occurred over a prolonged period of time due to the defective waterproofing and the resultant dampness in the floor and wall structures would be subject to the above mentioned exclusion.
In view of this, Insurers will be unable to offer any financial assistance in respect of these three incidents. We trust that this understand Insurers' position in relation to these incidents and we request that you complete and return the section at the base of the letter to confirm your acceptance.
In respect of incident 2, the damage results from the failure of a fixed plumbing apparatus and was a sudden event. There are no exclusions relating to damage of this nature and we consider policy liability to engage in respect of incident. We await your formal claim for this incident in due course.
