Following the termination of my employment with Thai Leighton I have provided my lawyers with copies of all employment documents / payment records and relevant e-mails between myself and Thai Leighton during the time of my employment (2008 to 2015). After reviewing those documents they have advised that regardless of the differing forms of employment contract used by Thai Leighton during this period, I was legally employed by Thai Leighton as an employee and should have received a termination payment equal to 240 days multiplied by the last daily rate at which I was paid.
Please find attached the record of my employment with Thai Leighton from 2008 to 2015. Also please note content of my e-mails sent to you in 2011 and 2012 when I explained that the circumstances of my employment on a Terms of Service Agreement were due to problems with Thai Leighton being unable to provide me with a work permit in 2008 and thus the original direct Employment Agreement was put on hold until Thai Leighton resolved the problem (which never happened). During this time the form of my Employment Contract was changed by Thai Leighton (due to Thai Leighton requirements) and this meant that the intention of the original proposed Employment Contract was not adhered to, including regular annual salary adjustments and the provision of the education allowance.
I would appreciate if you would review the figures included within this spreadsheet. The left side is a record of payments and adjustments, whilst the right side (in green) details the correct timing and rate of adjustments (per increased cost of living / inflation) which should have been undertaken. The difference between the two is shown in red. I have also provided the figures for the Education Allowance and the Termination Payment.
Please confirm your agreement to payment of the amounts shown as per the intent of my original employment and advise when this would be available. Please respond by 12pm on Monday 22nd June as I shall meet with my lawyers again on Monday afternoon to discuss my case / next necessary action
