Filing deadlines. If property is initially
seized for the purpose of civil forfeiture, the
government must file its complaint against the
property within ninety days of the filing of any
claim contesting an administrative forfeiture
proceeding. If the government fails to comply
with this deadline, and no exceptions apply, civil
forfeiture of the property in connection with the
offense for which it was seized is forever barred.
In contrast, criminal forfeiture actions are not
subject to any statutory deadlines.
